RA 7767 amended

Commissioner Florentino A. Tuason Jr., today announced that the amendment to the implementing rules and regulations of Republic Act 9006 – the Fair Elections Act – has been approved by the Commission en banc. The amendment is for the purpose of correcting an error in the IRR.

In brief, the 2007 IRR for the Fair Elections Act contains a provision that prohibits the publishing of survey results 15 days before elections. This provision originally appeared in 2001 but was struck down as unconstitutional by the Supreme Court. In the 2004 version of the IRR, this provision wasn’t included, but it made a comeback in 2007. Hence the troubles.

Now that the en banc has approved the amendment, the Resolution is being passed around for the signature of the Commissioners and will be released very soon. And still the world keeps on spinning…
