I’m sorry to everyone who commented or asked a question on this blog or in ecomelec, for not having been able to reply sooner. Anyway, I hope this post answers some – hopefully most – of your questions.

1. Teachers’ pay

a) The COMELEC is only giving 1,000 pesos, plus a transport allowance of 500 pesos. If the teachers also handled SK precincts, they get an additional 500 pesos. All in all, the minimum a teacher can get is 1,500 pesos; max, 2,000.

b) The idea that teachers would get 3 thousand stemmed from a Memorandum of Agreement between the COMELEC and the DepEd which mentioned that amount. What hasn’t been given focus is the fact that the MOA also says ‘subject to availability of funds.’ As it turns out, the DBM approved only the 500 peso transpo allowance – which is, therefore, the extent of the availability of funds.

c) Distribution of the funds for the payment of teachers is through the municipal treasurers, not the COMELEC field office.

2. Complaints etc.

a) Complaints about election campaign violations or flying voters should be documented (take pictures, shoot video, get samples), accompanied by the complainant’s affidavit, and submitted to the local COMELEC.

In the case of flying voters in particular, it’s important that you must have some sort of proof that they are registered elsewhere and that they’ve already voted there. Mere suspicions, doubts, apprehensions, concerns, or accusations don’t count.

b) If you have complaints about how the elections turned out (ex: those protesting their loss) consult a lawyer. If you’ve already retained or hired a lawyer, don’t let him bully you into asking the COMELEC what to do next – first of all, that’s his job; and second, the COMELEC will not give you an opinion. If you think you have a COMELEC opinion on your case, chances are, it’s an opinion that won’t hold any weight.

  1. sir james, may bayad pala yung pag-file ng contri & expenditures.. d2 s cabanatuan p180 bawat isa candidate n mg-file, pang photocopy daw ng form at notaryo… bale 4copies daw pong form eh karamihan naman po not applicable dahil non-partisan nga. di po ba? pwede po b kayo labas ng info bout filing ng contribution & expeditures.. thanks!!!   2. sir how about the BBOC ALLOWANCE who will pay?
    in our place, our treasurer received 3 checks indicated in these checks for what payment: 1. BETs Honorarium; 2. Transportation Allowance; BBOC Honoratium.
    In the memo from FSD, walang nakalagay na BBOC honorarium only additional 500 for BETs holding SK Precs. NAKAKALITO NA NAMAN.
    I’m confused because you’ve stated that additional 500 will be given to BETs holding SK Precincts and you did not mention RE: BBOC honorarium. Pero yong mga checks na nareceive walang nakalagay na for BETs Holding SK Prec.

  3. sir naman maaw na kayo sa mga field oficers. Pwede ba make the instrcutions clear regarding the payment for the BET’s whether the two five hundreds is for trasportation & Bet’s handling SK? or for BBOC kasi our treasurer prepared the payroll for BET’s honorarium of P1,000, transportation of 500.00 and BBOC is 500.00. now you are telling again that the other 500.00 is for BET’ handling SK. Ano ba talaga and totoo?

  4. if only our officials are making clear guidelines regarding the budget for BRGy and SK Elections that it should be shouldred by LGU Barangay, wla sanang problema that should have been included in the budget that they have prepared for the purpose. kaso yong mga official natin aya gumawa gawa pa ng budget sharing e hindi naman pala totoo. kaming andito sa field ang nagiging singungaling. please help!

  6. Sir James, question lang po on Comelec Chairmanship that needs your immediate response and clarifications. If the 1987 Constitution categorically prohibits any member of the Comelec from being appointed or designated in a temporary or acting capacity [Art IX-c, Sec. 1(2)], who designated Commissioner Borra as “Acting Chairman”?
